Terms And Conditions for User
THIS DOCUMENT IS AN ELECTRONIC RECORD IN TERMS OF INFORMATION TECHNOLOGY ACT, 2000 AND RULES THEREUNDER AS APPLICABLE AND THE PROVISIONS PERTAINING TO ELECTRONIC RECORDS IN VARIOUS STATUTES AS AMENDED BY THE INFORMATION TECHNOLOGY ACT, 2000.
I.Definitions:
The definition given below are defined and capitalized terms in these Terms and conditions for user, which will have the meaning assigned to them here below:
a)“Account” shall mean the account created by the user on the Application/website for availing the Services.
b)“Application” shall mean the mobile application updated from time to time by TEZ.
c)“Applicable Laws” shall mean and encompasses all relevant laws, statutes, enactments, legislative or parliamentary acts, laws, ordinances, rules, by-laws, regulations, notifications, guidelines, policies, directions, directives, and orders of any Indian court, tribunal, or governmental body.
d) “Additional Fee” shall mean any toll tax, duty, inter-state taxes, etc. which may have been incurred in providing the Services and payable to any third party / government authorities for undertaking the Ride under Applicable Law.
e)“Convenience Fee” shall mean the fee payable by the User to TEZ for the Service i.e., for availing value-added services including but not limited to technology services, door to door service, customer support and cashless payment options or other related services. Convenience Fee may also include any such fee that may be charged by third parties towards providing access to a particular location such as airports, railway stations etc.
f) “Cancellation Fee” shall mean a fee payable by User, towards cancellation of a Ride or a booking as detailed mentioned under cancellation clause of these Terms and conditions and the Cancellation policy.
g)“City” shall mean a city in which the User and Drivers avail and render the transportation services respectively. All the services avail or rendered by User or drive should be in same city.
h)“Customer/User/ You” means a person who has an Account on the Application or website.
i)“Driver” shall mean and include an individual as may be evaluated, appointed and trained by an operator associated with us to provide the transportation services and persons who are registered with TEZ and own such Vehicles with necessary city taxi permits and other applicable transport vehicle permits and licenses to provide transportation services within the City.
j)“E-Wallet” shall mean a pre-paid instrument, which can be used to make payments.
k)“Fare” shall mean an amount payable by User in local currency Indian Rupees, which is shown in Application at the time of ride completion, as the fare payable towards the distance travelled and time taken for the specific Ride. Fare may depend on several factors such as the availability of the Driver(s) on the platform at the time, city and may also reflect the fares that may have been stipulated by the respective Governments from time to time. It may include components to reflect any promotions carried out by TEZ.
l)“Force Majeure Event” shall mean any event arising out of control of TEZ, including but not limited to heavy rain, strikes, natural calamities etc.
m)“Primary User” shall mean the user who have done the registration process and entered all the personal data.
n)“Registration” shall mean and may include the present, valid, true and as per KYCs name, email ID, phone number and such other personal information as may be required by TEZ from the User from time to time for registration on the Application or to create account with TEZ.
o)“Ride” shall mean the travel or booked ride in the Vehicle by the User which is booked through the Site or application.
p)“Service(s)” means the booking of the services by TEZ through the Application, website or via any other mode of TEZ, or booking on the Site.
q)“Site” shall mean the Application available on google play store or apple store and the website operated by TEZ or any other software that enables the use of the Application or such other URL as may be specifically provided by TEZ.
r)“Substitute Vehicle” shall mean another vehicle arranged for transporting the User to his/her destination, in the event of a Vehicle breakdown or other unforeseen events.
s)“TEZ” or “us” or “we” or “our” or “Service Provider” shall mean M/s TEZ Taxi Private Limited, a company incorporated under the provisions of the Companies Act, 2013 and having its registered office at 8/201 Vachnamrut Residency, Atladara, Vadodara - 390 012 India, which expression shall, unless it be repugnant to the context or meaning thereof, be deemed to mean and include all its successors, affiliates and permitted assigns.
t)“Total Ride Fee” may comprise one or more of the following components that shall be levied to the ride based on various parameters including but not limited to distance travelled, time taken for the ride, city in which the ride is hailed, time of the day, availability of drivers nearby – (i) Minimum fare, (ii) Base fare (iii) Per kilometre fare (based on the total distance of the ride), (iv) Per minute charges (based on the time taken to complete the ride) (v) Pre-wait charges (if any), (vi) Third party charges like insurance premium (if applicable) (vii) peak charges (when applicable)* (viii) Past dues (if any); and (ix) Applicable taxes. *Both fares and peak charges may vary on the basis of various market dynamics such as cost of living, fuel pricing, vehicle maintenance costs, interest rates, demand and supply situation, etc.
u)“T&Cs” and “Terms and conditions” shall mean these terms and conditions for User or customer.
v)“TPSP” shall mean a third-party service provider.
w)“Vehicle” shall mean a motor cab as defined under the Motor Vehicles Act,1988.
II.Eligibility
User will be able to use services provided by TEZ under below conditions:
(i)Users must be at least 18 years of age
(ii)Legally capable of entering into a binding contract under Indian law.
III.Registration And Account
Users must provide accurate and complete information during the registration process and maintain the security of their Account credentials. User understand and acknowledge that registration process can be proceed only after complying with the requirements and by entering Your Registration Data.
i) User shall ensure that the Data provided for registration is accurate, complete, valid, true and is updated from time to time. TEZ shall not liable for any false, incomplete, inaccurate, invalid, old or incorrect Registration Data provided by User.
ii) User is solely responsible for maintaining the confidentiality of Registration Data entered by them and will be liable for all activities and transactions that occur through User’s Account, whether initiated by User or any third party. User’s account cannot be transferred, assigned or sold to a third party. TEZ shall not be liable for any loss of data, account, lost of personal data that user may incur as a result of someone else using their credentials, password or Account, either with or without Primary User’s knowledge.
iii) TEZ reserve the right to suspend or terminate User’s Account with immediate effect and for an indefinite period, if we have a reason to believe that the Registration Data or any other data provided by User is incorrect or false, or that the security of User’s Account has been compromised in any way, or for any other reason We may find just or equitable.
iv) Except for Registration Data or other Permitted Information submitted by the User, TEZ does not seek or require confidential or proprietary information from Users unless mandated by Applicable Laws. By accepting these Terms, Users agree that any non-Permitted Information shared with TEZ will not be considered confidential or proprietary.
v) It is responsibility of User to download the correct application for their device, and We are not liable for incompatibility issues or if User download the wrong version. We reserve the right to terminate the Service if User use an unauthorized device. User agree to comply with all applicable laws when using the Services and may only use them for lawful purposes only (e.g., no transport of unlawful or hazardous materials). User must not cause nuisance, annoyance, inconvenience, or property damage to any party, including the Third-Party Provider. In certain instances, proof of identity may be required to access the Services, and refusal to provide such proof may result in denial of access.
vi) For any unauthorized use of User Account, contact us immediately at help@teztaxi.in. If You are unable to access Your Account, inform us at the same email with a written request to block it. We are not liable for unauthorized transactions made and hold no liability in case of a Force Majeure Event.
IV.The Services
The Services provided by TEZ constitute a SaaS (Software-as-a-Service) technology platform that enables users of TEZ’s mobile applications or websites to arrange and schedule transportation and/or logistics services with independent third-party providers, including transportation and logistics providers under agreements with TEZ or its affiliates ("Third Party Providers"). Unless otherwise agreed in writing, the Services are available solely for personal, non-commercial use, or any other use at TEZ’s discretion. You acknowledge that TEZ does not provide transportation or logistics services nor functions as a transportation carrier, and all such services are provided by independent third-party contractors who are not employed by TEZ.
License. Subject to compliance with these Terms and conditions, TEZ grants User a limited, non-exclusive, non-sublicensable, revocable, and non-transferable license to: (i) access and use the Application on your personal device solely for utilizing the Services; and (ii) access and use any content, information, and related materials made available through the Services, strictly for personal, non-commercial use. Any rights not expressly granted herein remain reserved by TEZ and its licensors.
Restrictions. User may not: (i) remove copyright, trademark, or proprietary notices from any part of the Services; (ii) reproduce, modify, distribute, sell, transfer, publicly display, or exploit the Services, except as expressly permitted by TEZ; (iii) decompile, reverse engineer, or disassemble the Services, except where permitted by law; (iv) link to, mirror, or frame any part of the Services; (v) run programs or scripts for data mining, scraping, or overloading the Services; or (vi) attempt unauthorized access to any part of the Services or related systems.
Provision of the Services. The Services may be provided under TEZ’s brands and request options for transportation and logistics. These Services may also be offered by TEZ’s subsidiaries, affiliates, or independent Third-Party Providers with necessary permits, authorizations, or licenses.
Third-Party Services and Content. The Services may integrate with third-party services and content (including advertisements) that TEZ does not control. Different terms and privacy policies may apply to such third-party services. TEZ does not endorse third-party services and is not responsible for their products or services. Additionally, companies such as Apple Inc., Google Inc., and Microsoft Corporation may act as third-party beneficiaries to this contract when accessing the Services via their devices, but they are not responsible for providing or supporting the Services.
Ownership. All rights in the Services remain the property of TEZ or its licensors. These Terms do not grant User rights in or related to the Services except as specified, nor any rights to use TEZ’s name, trademarks, logos, or those of its licensors.
V.Your Use of The Services
The Services provided by TEZ allow users to arrange and schedule transportation and logistics services through TEZ’s mobile applications or websites. These services are fulfilled by independent third-party providers under agreements with TEZ or its affiliates ("Third Party Providers"). TEZ does not provide transportation or logistics services and is not a transportation carrier; all such services are offered by independent contractors.
User Accounts and Conduct. To use the Services, you must create an account, providing accurate and up-to-date personal information. You are responsible for maintaining account security and all activities under your account. The Services are only available to users aged 18 and above. You may not assign or transfer your account, authorize third-party use, or use the Services for unlawful purposes, including the transport of prohibited materials. You may be required to provide proof of identity, and failure to do so may result in denied access.
License and Restrictions. TEZ grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Application for personal, non-commercial purposes. You may not (i) remove copyright or proprietary notices, (ii) reproduce, distribute, or exploit the Services beyond permitted use, (iii) reverse engineer or tamper with the Services, (iv) frame or mirror any part of the Services, or (v) attempt unauthorized access.
Third-Party Services and Content. The Services may include third-party services and content, including advertisements, which TEZ does not control. Different terms and privacy policies may apply to these third-party services, and TEZ holds no responsibility for them. Additionally, companies like Apple Inc., Google Inc., and Microsoft Corporation may be third-party beneficiaries of this contract but are not responsible for service provision or support.
Promotional Codes. TEZ may offer promotional codes or coupons subject to specific terms, including validity periods, applicability to certain rides, referral-based offers, or any other conditions that may be mentioned on the coupon at TEZ’s discretion. Such codes are non-transferable, non-redeemable for cash, and may be revoked at TEZ’s discretion if found to be misused or obtained fraudulently.
User Content. You may submit feedback, reviews, or other content (“User Content”) to TEZ. By doing so, you grant TEZ a worldwide, royalty-free license to use, modify, and distribute this content. You represent that you own or have the necessary rights to the content and that it does not violate any laws or third-party rights. TEZ may review and remove content at its discretion.
Network Access and Devices. You are responsible for obtaining network access and compatible devices to use the Services. Data charges may apply, and TEZ does not guarantee compatibility with all devices. The Services may experience disruptions due to internet and electronic communication issues.
Ownership. All rights in the Services remain the property of TEZ or its licensors. These Terms do not grant you rights beyond the limited license specified, nor any rights to use TEZ’s trademarks, logos, or other intellectual property.
VI.Confirmation Of Booking
TEZ shall, upon receiving the booking request from You in the manner set out above, proceed to confirm or decline the booking based on the availability of Vehicles at the pickup time and location, which shall be informed to You via the application, SMS, or email. In the event the booking is confirmed, You shall check the booking details, including but not limited to pick-up time and pick-up location. If there are any incorrect details, you may cancel the ride, subject to applicable charges and cancellation policies set by TEZ.
Upon confirmation of booking, a One-Time Pin (OTP) shall be provided on the Application, which shall be further shared by the Customer with the Driver. In the event that the Customer does not provide the OTP to the Driver, the Driver shall not be responsible for not starting the services.
You shall bear the consequences and damages for any delay that may be caused to You due to Your failure to check the confirmation message via the application, SMS, or email or failure to inform TEZ of the incorrect details immediately.
VII.Charges and Payments
By using the Services, you acknowledge that you may incur charges for the transportation or logistics services provided by Third-Party Providers (“Charges”). After receiving such services or goods, TEZ will facilitate the payment on behalf of the Third-Party Provider, acting as their limited payment collection agent. This payment process will be considered equivalent to direct payment to the Third-Party Provider. Charges may include applicable fees, tolls, surcharges (such as booking fees, municipal tolls, and airport surcharges), and any applicable taxes as required by law. Payments made are final and non-refundable unless otherwise determined by TEZ.
You are responsible for making the full payment for the ride upon its completion. Failure to do so may result in TEZ initiating a claim to recover the outstanding amount through appropriate means.
You have the right to request a modification of Charges from the Third-Party Provider at the time of receiving the service. TEZ will facilitate any modifications requested by the provider accordingly.
All Charges are due immediately and will be processed using the preferred payment method linked to your account. If your primary payment method fails, TEZ may charge an alternative payment method associated with your account. A receipt for the transaction will be provided via email.
TEZ reserves the right to modify, remove, or adjust Charges at any time. You acknowledge that Charges may fluctuate based on demand, particularly in peak hours or high-traffic areas. While TEZ will make reasonable efforts to notify you of applicable Charges, you are responsible for any Charges incurred under your account. Certain users may receive promotional offers or discounts at TEZ’s discretion, which will not impact the Charges applicable to other users.
You may cancel a service request before the arrival of the assigned Third-Party Provider. However, a cancellation fee may be applied in such cases.
The payment structure is designed to fully compensate the Third-Party Provider for the service or goods delivered. Unless explicitly stated for specific services, TEZ does not allocate a portion of your payment as a tip. While tipping is entirely voluntary, you may choose to provide additional payment directly to the Third-Party Provider. After receiving services, you will have the opportunity to rate your experience and leave feedback.
Repair or Cleaning Fees. You are responsible for covering the cost of repairs or necessary cleaning of Third-Party Provider vehicles or property if damage or excessive cleaning is required beyond normal wear and tear due to your use of the Services. If a Third-Party Provider reports such damage or cleaning needs, and TEZ verifies the claim at its reasonable discretion, TEZ reserves the right to process payment for the necessary repair or cleaning costs using the payment method associated with your account. These amounts will be transferred to the respective Third-Party Provider and are non-refundable.
VIII.Cancellation Policy
If you decide to cancel a ride, TEZ will inform you about any applicable cancellation charges through the app before finalizing the cancellation. You acknowledge that while you have the flexibility to cancel your ride request at any time, a cancellation fee may be applied. The fee amount will be clearly displayed on the app or website before you confirm the cancellation. By using TEZ's services, you agree to pay any applicable cancellation fee, which may either be deducted from your next ride’s fare or require immediate payment before you can book another ride. TEZ may, at its discretion, adjust this fee to be included in the total fare of your next ride, either with or without requiring immediate payment.
The cancellation fee must be paid immediately upon being charged. However, TEZ may, at its discretion, adjust this fee to be included in the total fare of your next ride. All payments related to the cancellation fee will follow the standard payment terms set by TEZ. However, if the driver cancels the ride, you will not be obligated to pay any cancellation fee.
IX.User Violation of User Terms
You are strictly prohibited from smoking, consuming alcohol, or carrying any illegal substances while using TEZ’s services. Additionally, any form of misconduct, including misbehaviour with the driver, causing distractions, or violating applicable laws, is not permitted. If you are found engaging in such activities, TEZ reserves the right to impose a fine or terminate the ride immediately. Failure to pay the fine after ride completion may result in further action in accordance with the law. Persistent violations, refusal to pay fines, or inappropriate behaviour may lead to your account being blacklisted or permanently deactivated from TEZ’s platform.
X.Emergency Services to Customer
By accepting these User Terms and utilizing the SOS / Emergency feature on the TEZ application, you acknowledge and consent to TEZ making every reasonable effort to assist you in situations involving safety concerns, emergencies, or distress, in accordance with its internal emergency response policies. TEZ may take necessary actions, including but not limited to, the following measures to ensure your safety.
When you activate the SOS button/ Emergency button and report a safety issue, a TEZ representative may escalate the matter internally or coordinate with third-party security providers to offer assistance. Depending on the severity of the situation, response teams may be dispatched to your location to address the incident effectively.
TEZ may also inform relevant government authorities, such as local law enforcement, regarding the incident and request their assistance. In doing so, TEZ may share necessary personal details, including your precise GPS location, registered email address, and contact number, to facilitate an appropriate response to your situation. Additionally, TEZ may collaborate with third-party security providers to ensure a swift resolution of the incident. To enable their support, TEZ may share essential personal details with these providers solely for the purpose of addressing the emergency.
You may receive calls from TEZ representatives or the designated response teams after activating the SOS feature / Emergency feature and throughout the duration of the emergency response. Such communications are strictly for your safety and shall not be considered a violation of regulatory guidelines.
By using this feature, you explicitly permit TEZ to take the necessary steps outlined above, along with any additional actions required to provide an effective emergency response.
TEZ will make every effort to assist you during an emergency; however, it shall not be held liable for any service limitations or deficiencies. This provision does not prevent you from seeking assistance from other sources as needed.
XI.Force Majeure
TEZ shall not be held liable for any delay, disruption, or failure in providing its services due to circumstances beyond its reasonable control. Such circumstances may include, but are not limited to, natural disasters, earthquakes, floods, hurricanes, or other extreme weather conditions; acts of war, terrorism, civil unrest, or governmental actions; power failures, network outages, cyber-attacks, or technical malfunctions; strikes, labour disputes, pandemics, or public health emergencies; or any other unforeseen events that prevent TEZ from fulfilling its obligations. In such cases, TEZ shall make reasonable efforts to resume services as soon as conditions allow, but it shall not be responsible for any resulting inconvenience, loss, or damage arising from these uncontrollable events.
XII.Content Posted by Users.
TEZ reserves the right to monitor, review, and remove any content posted by users on its platform that is deemed inappropriate, offensive, unlawful, misleading, or in violation of these terms and conditions. This includes, but is not limited to, reviews, comments, feedback, images, or any other form of user-generated content that contains hate speech, defamatory statements, explicit material, threats, harassment, false information, or any content that infringes upon the rights of others. TEZ may take necessary action, including suspending or terminating user accounts, restricting access, or reporting violations to the relevant authorities. Users are solely responsible for the content they post and must ensure that it aligns with ethical guidelines and applicable laws. TEZ disclaims any liability for user-generated content but will take reasonable steps to ensure a safe and respectful environment for all users.
XIII.Disclaimers; Limitation of Liability; Indemnity.
Disclaimer. TEZ provides its services on an "as is" and "as available" basis without any warranties, express or implied. TEZ disclaims all representations and warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. TEZ does not guarantee that the services will be uninterrupted, error-free, or always available. Furthermore, TEZ makes no assurances regarding the quality, reliability, safety, or suitability of third-party service providers or the services and goods provided through them. By using the services, you acknowledge and accept that all risks associated with such use rest solely with you, to the maximum extent permitted under applicable law.
Limitation of Liability. TEZ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, personal injury, or property damage, arising with the use of the services. This includes any inability to access or use the services or any interactions with third-party providers. TEZ is not responsible for delays, service failures, or any issues beyond its reasonable control. Additionally, TEZ does not guarantee that all third-party providers offering transportation services through its platform are professionally licensed or authorized. In no case shall TEZ's total liability for all claims, damages, and losses exceed 50% of your fare charges, and not more than that.
TEZ acts solely as a facilitator, allowing users to connect with independent third-party transportation, goods, or logistics providers. TEZ holds no liability for any acts, errors, or omissions by such third-party providers unless expressly stated otherwise in these terms.
Indemnity. You agree to indemnify and hold TEZ, its affiliates, directors, officers, employees, and agents harmless from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from: (i) your use of TEZ’s services or any services/goods obtained through the platform; (ii) any violation or breach of these terms by you; (iii) TEZ’s use of any content submitted by you; or (iv) any infringement of third-party rights by you, including claims from third-party providers..
XIV.Lost Property
You acknowledge and agree that it is your sole responsibility to ensure that you collect all your belongings before exiting a TEZ-affiliated vehicle. If you happen to leave behind any personal property, the driver may choose to return it directly to you or hand it over to TEZ or its local service partner.
While TEZ encourages drivers to return lost items to their rightful owners or designated TEZ offices, TEZ and its local service partners are not liable if a driver fails to do so. Additionally, TEZ assumes no responsibility for any loss, theft, or damage to your belongings while they are in transit.
In cases where lost property is handed over to TEZ or its local service partner, reasonable efforts will be made to identify and contact the rightful owner. However, you understand and agree that TEZ or its local service partner will retain lost items for a maximum period of one month from the date of receipt. If you do not claim your belongings within this period, TEZ reserves the right to dispose of or manage the unclaimed items as it deems appropriate, and you shall have no claim against TEZ regarding the uncollected property.
XV.Governing Law; Arbitration - Vadodara
Except as otherwise stated in these Terms, these Terms shall be exclusively governed by and interpreted in accordance with the laws of India, without reference to its conflict of law principles. Any dispute, conflict, claim, or controversy arising out of or in connection with the Services or these Terms, including but not limited to their validity, interpretation, or enforceability (referred to as a "Dispute"), shall first be subject to mandatory amicable mediation between the parties for a period of thirty (60) days If the Dispute remains unresolved within this period, it shall then proceed to mediation under the provisions of the Arbitration and Conciliation Act, 1996.
If the Dispute remains unresolved within sixty (60) days from the date of submission for mediation under the Arbitration and Conciliation Act, 1996, the matter shall be exclusively and finally settled through arbitration as per the same Act. The arbitration shall be conducted by a sole arbitrator, appointed in accordance with the provisions of the Arbitration and Conciliation Act, 1996. The seat and venue for both mediation and arbitration shall be Vadodara, Gujarat. The arbitration proceedings shall be conducted in English.
All information related to the mediation and arbitration process, including documents, submissions, correspondence, and decisions issued by the mediator or arbitrator, shall be treated as strictly confidential. Such information shall not be disclosed to any third party without the express written consent of the other party, except where:
(i) disclosure is reasonably required for the conduct of the mediation or arbitration process, or
(ii) the third party agrees in writing to abide by the same confidentiality obligations.
By using TEZ’s services, you agree to abide by these dispute resolution procedures and waive any rights to initiate legal proceedings in any jurisdiction outside the agreed terms.
XVI.Claims Of Copyright Infringement
If you believe that any content available on TEZ’s platform infringes upon your copyright, you should notify TEZ immediately by providing a detailed claim of copyright infringement. Your notice should include specific information such as a description of the copyrighted work, details of the infringing content, its location on the platform, and your contact information. TEZ takes intellectual property rights seriously and will promptly investigate any valid claims. Upon verification, TEZ reserves the right to remove or restrict access to the infringing content and may take further action, including suspending or terminating the account of the user responsible for the infringement. Additionally, TEZ may share relevant details of the claim with the concerned parties to facilitate resolution. However, submitting false or misleading copyright claims may lead to legal consequences.
XVII.Notice
All official communications, notifications, or updates related to these Terms shall be conveyed through the TEZ Application or via email. Users are responsible for regularly checking the Application and their registered email for important notices. Any notice sent by TEZ shall be deemed received once it is dispatched through these channels. For any queries, concerns, or legal notices, users may contact TEZ at the following address:

TEZ reserves the right to modify, amend, or update these Terms at its sole discretion at any time. Such modifications may be made to enhance services, comply with legal requirements, or reflect operational changes. Users will be notified of any updates via the Application or email, and continued use of TEZ’s services after modifications implies acceptance of the revised Terms. It is the user’s responsibility to review these Terms periodically.
XIX.Safety
Ensuring the safety of passengers and drivers is a fundamental priority at TEZ. Users must adhere to all applicable traffic laws, wear seat belts, and follow prescribed safety guidelines during their rides. Any reckless behaviour, violation of traffic rules, or engagement in activities that compromise safety may result in penalties, suspension, or termination of the User’s access to TEZ’s services. Users are encouraged to report any safety concerns through the TEZ Application to help maintain a secure and reliable transportation experience.
